IMPORTANT INFORMATION FOR INTENDING BUYERS

BUYER’S PREMIUM
WEEKLY AND MONTHLY AUCTIONS

The purchase price of each lot will be the hammer price plus a buyer’s premium of 17.6% (incl GST) on the first $5000 of each lot, then 11% (incl GST) on the balance of each lot purchased.

SEASONAL AUCTIONS

A flat
20% commission (incl GST) is applicable for all seasonal auctions

OWNERSHIP

Leonard Joel acts solely as agent for the vendor and does not have any ownership in any lot whatsoever.

PRE-SALE ESTIMATES

Leonard Joel publishes with each catalogue an estimated price range for each lot. Any estimate given by Leonard Joel whether written or oral is a matter of opinion as to the price expected at auction and is intended as a guide only. Estimates are prepared well in advance of auction and are subject to revision. Estimate prices do not include the buyer’s premium.

RESERVES

The reserve is the minimum price the vendor is willing to accept at auction. The reserve amount is confidential and in most cases will not exceed the low pre-sale estimate.

PAYMENT, COLLECTION AND STORAGE OF PURCHASES

All items purchased must be paid for in full together with the buyer’s premium and any other charges incurred, and collected within three (3) working days of purchase. Payment can be made by credit card (Bankcard, MasterCard or Visa), cash, bank cheque, personal cheque (by prior arrangement with Leonard Joel). Any purchases uncollected within three (3) working days of the sale may be moved to a commercial storage facility or stored at Leonard Joel, which would attract a commercial storage fee commencing from the date of purchase. The packing and handling of purchases is entirely at the expense of the buyer.

INSURANCE

It is the responsibility of the buyer to cover by insurance all items purchased from the time of the fall of the hammer.

CONDITION REPORTS

Condition reports both verbal and written may be provided by Leonard Joel upon request. The opinions expressed in the condition reports are a guide only and should not be treated as a statement of fact. Prospective buyers are encouraged to inspect articles for sale at our pre-sale viewing where Leonard Joel staff are available for advice.

BIDDING AT AUCTION

It is the intention of Leonard Joel to provide buyer’s numbers for bidding at each auction. These are available during viewing times and during the auction from reception.

ABSENTEE BIDDING

Absentee bidding is offered by Leonard Joel as a complimentary service for the convenience of prospective buyers who are unable to attend an auction in person. All written instructions for absentee bidding must include the lot number, item description and bid amount together with the prospective buyers name, address and telephone numbers during business hours. Bids can be registered via facsimile or email (refer to back of catalogue for absentee bidding form). Unlimited bids will not be accepted. In the event of identical bids the first bid received will take precedence. All buyers are notified when bids are successful and must pay and collect as per Payment, Collection and Storage of Purchases as set out above.

Leonard Joel accepts absentee bids without legal obligation of any kind and will not be held responsible for any losses arising from missed bids.

TELEPHONE BIDDING

Telephone bidding can be pre-arranged with Leonard Joel. All applications for telephone bidding must be arranged at least six (6) hours prior to the commencement of the session of the auction. The allotment of resources for telephone bidding is strictly limited and Leonard Joel reserves the right to refuse any application for telephone bidding. Leonard Joel accepts telephone bids without legal obligation of any kind and will not be held responsible for any losses arising from missed bids.

AUSTRALIAN PROTECTION OF MOVEABLE CULTURAL HERITAGE ACT 1986

Leonard Joel can advise buyers on the Australian Protection of Moveable Cultural Heritage Act 1986. It is the responsibility of the buyer to obtain the necessary permit if necessary for the item to be exported.

VALUATIONS

Leonard Joel are approved valuers to the Australian Government and offer comprehensive written valuations for Insurance, Market, Probate and other purposes with absolute discretion and security. Appraisals can be arranged by telephoning our office and arranging a suitable appointment time. Fees for valuations may be refundable should those items be offered for auction at Leonard Joel within twelve (12) months from of the date of valuation.

CONDITIONS OF SALE

  1. The highest bidder shall be the buyer. In the event of any dispute as to the bidding in respect of any lot, that lot may be offered again at the discretion of the auctioneer whose decision shall be absolute and final.
  2. The auctioneer has the right to:
    1. Refuse any bid
    2. Advance the bidding at his absolute discretion
    3. Place a reserve on any lot
    4. Place a bid or bids on behalf of the vendor
    5. Withdraw any lot from sale
    6. Require a successful bidder to pay forthwith the whole or any part of the purchase price
  3. The auctioneer acts only as the agent of the vendor and neither the auctioneer nor the vendor shall be responsible for any defects or faults in any lot or for any errors of description or for genuineness or authenticity of any lot and no compensation shall be paid in respect of same. From the time of the lot being sold such lot will be the responsibility of the buyer.
  4. Notwithstanding any other terms and conditions, if within fourteen (14) days after the sale, Leonard Joel shall receive from the buyer notice in writing accompanied by the written opinion of two (2) competent experts or authorities that the property is a forgery and not later than seven (7) days after such notification the buyer returns the property to Leonard Joel in the same condition as at the time of sale and satisfies Leonard Joel that the property is a forgery, the purchase price shall be refunded.
  5. Each lot shall be paid for in full together with any other charges incurred and removed at the buyers expense not later than three (3) working days after the date of purchase failing which the auctioneer and/or the vendor shall have the right to resell the lot either by public or private sale and any deficiency on and costs of resale shall be borne by the defaulting buyer.
  6. Lots purchased may not be removed until payment in full has been made to Leonard Joel.

  9. Some descriptions in the catalogue make reference to damage. This information is provided for guidance only and absence of such a reference does not imply that a lot is free from damage and/or restoration, nor does any reference imply the absence of other faults.
  10. Jewellery and watches offered by Leonard Joel are sometimes accompanied by an Independent Valuation as stated in the catalogue. These valuations are conducted by registered valuers and are offered purely as independent opinions. Variation may be found as to the colour, clarity and size of stones described in these reports, consequently Leonard Joel does not guarantee these Independent Valuations. Wristwatches and pocket-watches are offered in their current condition and Leonard Joel does not guarantee that they are in working order. Items may be thoroughly inspected during the viewing period or by prior arrangement.

Leonard Joel conducts all auctions on a GST inclusive basis therefore GST will only be added to the buyer’s premium and vendor’s commission charges.

Items marked in the catalogue with the dagger (†) symbol indicates that the lot is being offered on behalf of as GST registered source.

Leonard Joel will supply all buyers and vendors with appropriate tax invoices as per Australian Taxation Office guidelines.
